Welcome to DALZO. These Terms & Conditions govern your access to and use of the DALZO website, products, coaching services, training programs, consultations, digital materials, communications, and other offerings provided by DALZO.
By accessing the DALZO website, purchasing a product or service, enrolling in coaching, creating an account, or otherwise using DALZO content or services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
If you do not agree to these Terms & Conditions, you should not use the website, purchase DALZO products or services, or participate in DALZO programs.
ABOUT DALZO
DALZO is an endurance-focused brand that may offer athletic apparel, accessories, fitness and performance coaching, training programs, general nutrition and wellness education, consultations, digital resources, educational content, community experiences, and related products or services.
The availability, pricing, features, and details of DALZO products and services may change at any time.
ELIGIBILITY
You must be at least 18 years old to purchase DALZO coaching services or enter into a binding agreement with DALZO.
Individuals under 18 may use the website or purchase products only with the involvement and permission of a parent or legal guardian.
By using the website or purchasing from DALZO, you represent that the information you provide is accurate and that you are legally permitted to enter into the applicable transaction.
PRODUCTS AND SERVICES
DALZO may offer:
Athletic apparel and accessories
Endurance and performance-related products
Individual or group coaching
Fitness and athletic training programs
General nutrition, fueling, and wellness education
Consultations and assessments
Digital programs, guides, templates, or resources
Community events or experiences
Other related products and services
DALZO reserves the right to modify, replace, limit, suspend, or discontinue any product or service at any time.
PRODUCT INFORMATION
DALZO makes reasonable efforts to accurately display product descriptions, photographs, materials, measurements, sizing information, colors, and other product details.
However, actual product appearance may vary slightly because of:
Screen and device settings
Lighting and photography
Manufacturing tolerances
Material variations
Product improvements or revisions
Differences between samples and final production
DALZO does not guarantee that every photograph, color, measurement, or product description will be completely free from errors.
Customers are responsible for reviewing available sizing information and product details before completing a purchase.
PRICING AND AVAILABILITY
Unless otherwise stated, prices are displayed in United States dollars.
Prices, discounts, promotions, product availability, and service packages may change without prior notice.
DALZO reserves the right to:
Correct pricing or description errors
Limit purchase quantities
Refuse or cancel an order
Discontinue products or services
Reject transactions suspected of fraud, resale, abuse, or unauthorized activity
Withdraw or modify promotions
If DALZO cancels an order after payment has been processed, the applicable amount will be refunded to the original payment method.
ORDERS
Submitting an order does not guarantee acceptance.
An order is accepted when DALZO confirms the purchase or begins processing or fulfilling the order.
You are responsible for providing complete and accurate:
Billing information
Shipping information
Contact information
Payment information
Product selections
Sizing selections
DALZO is not responsible for delays, failed deliveries, returned packages, or additional expenses caused by inaccurate or incomplete information provided by the customer.
Contact DALZO promptly if you discover an error in an order. DALZO cannot guarantee that an order can be changed after processing or fulfillment has begun.
PAYMENT TERMS
Payment is due at the time of purchase unless different terms are provided in writing.
Payments may be processed through third-party payment providers such as Stripe, PayPal, or another authorized payment processor.
By submitting payment information, you authorize DALZO and its payment providers to charge the selected payment method for all amounts disclosed at checkout, including:
Product or service prices
Applicable taxes
Shipping charges
Recurring coaching or membership fees
Other disclosed charges
DALZO may suspend, postpone, or terminate an order or service because of:
Unpaid balances
Failed payments
Expired payment methods
Reversed or disputed payments
Unauthorized chargebacks
Suspected fraud
Violation of these Terms & Conditions
COACHING BILLING AND AUTOMATIC RENEWAL
Unless a different arrangement is clearly disclosed and agreed to in writing, recurring DALZO coaching is provided and billed on a month-to-month basis.
Each monthly payment covers no more than the following 30 days of coaching services.
By enrolling in recurring coaching, you authorize DALZO and its payment provider to charge your selected payment method on the billing schedule disclosed during enrollment.
Before payment, DALZO will disclose:
The amount charged
The billing frequency
The services included
Whether the service renews automatically
How the service may be canceled
You may cancel recurring coaching using the same method by which you enrolled or through another cancellation method provided by DALZO, including written notice sent to DALZO.
Cancellation prevents future renewal charges after the cancellation becomes effective. It does not automatically refund charges already processed or services already provided, except where required by law or expressly stated in a written coaching agreement.
To avoid the next scheduled charge, a cancellation request must be received before the next billing date.
SHIPPING AND DELIVERY
Shipping and delivery dates are estimates unless DALZO expressly guarantees a specific date in writing.
DALZO will make reasonable efforts to ship orders within the timeframe displayed at checkout or otherwise communicated to the customer.
If DALZO cannot ship an order within the represented timeframe, DALZO may provide:
A revised estimated shipping date
An opportunity to consent to the delay
An opportunity to cancel the affected order
A refund when required
Processing or delivery may be affected by:
Product availability
Manufacturing delays
Fulfillment delays
Carrier delays
Weather or natural events
Holidays
Customs processing
Incorrect shipping information
Events outside DALZO’s reasonable control
DALZO is not responsible for carrier delays after an order has been transferred to the shipping provider, but DALZO will make reasonable efforts to assist customers with legitimate delivery issues.
LOST, STOLEN, OR DAMAGED ORDERS
Customers should promptly inspect delivered orders.
Claims involving missing, damaged, defective, or incorrect products must be submitted within the timeframe stated in the DALZO Shipping or Return Policy.
DALZO may require:
Photographs of the item
Photographs of the packaging
The order number
Shipping information
Other reasonable documentation
DALZO is not responsible for packages stolen after confirmed delivery to the shipping address provided by the customer, except where otherwise required by law.
INTERNATIONAL ORDERS
Customers outside the United States may be responsible for:
Customs duties
Import taxes
Brokerage fees
Government charges
Other destination-country fees
These charges may not be included in DALZO’s product prices or shipping charges.
International customers are responsible for understanding the import and delivery requirements applicable to their location.
RETURNS, EXCHANGES, AND REFUNDS
Product returns, exchanges, and refunds are governed by the DALZO Return and Refund Policy in effect at the time of purchase.
Returned products must satisfy the eligibility requirements stated in that policy.
Certain products may be ineligible for return, including:
Worn, washed, or used products
Products damaged after delivery
Products missing original packaging or tags
Customized or personalized products
Final-sale or clearance products
Gift cards
Downloaded digital products
Hygiene-sensitive products where applicable
Original shipping charges and return-shipping charges may be nonrefundable unless the product was defective, incorrect, or otherwise eligible for reimbursement under the applicable policy or law.
DALZO reserves the right to reject returns that do not comply with the Return and Refund Policy.
COACHING AND EDUCATIONAL SERVICES
DALZO may provide fitness coaching, endurance coaching, training programs, performance education, accountability, general nutrition and fueling education, wellness recommendations, and related services.
DALZO coaching and educational services are intended to support general fitness, athletic performance, habit development, and personal goals.
DALZO does not guarantee continuous access to a particular coach, communication platform, software provider, workout facility, or third-party service.
Specific coaching deliverables, response expectations, communication methods, and program details may be provided in a separate coaching agreement.
NUTRITION AND WELLNESS INFORMATION
Unless services are provided by an appropriately licensed professional, DALZO provides only general nutrition, fueling, habit, and wellness information.
DALZO does not represent itself as a licensed dietitian, licensed nutritionist, nutrition counselor, physician, or other licensed healthcare provider.
DALZO does not provide medical nutrition therapy or nutrition treatment for diseases or medical conditions requiring professional medical intervention.
Nutrition and wellness information may include general education relating to:
Hydration
Athletic fueling
Meal structure
Protein and carbohydrate intake
Recovery habits
General food choices
Performance-related routines
You are responsible for consulting a qualified healthcare professional regarding medical conditions, allergies, eating disorders, medication interactions, pregnancy, therapeutic diets, or other circumstances requiring individualized medical care.
NO MEDICAL ADVICE
DALZO is not a medical provider.
Information provided through coaching, training programs, consultations, emails, social media, videos, website content, digital resources, or educational materials is not intended to:
Diagnose a disease, injury, or medical condition
Treat or cure a disease or medical condition
Replace medical care
Replace physical therapy
Replace mental-health treatment
Replace advice from a physician or licensed healthcare professional
You should consult a qualified healthcare professional before beginning or changing an exercise program, nutrition routine, supplement routine, recovery protocol, or other health-related practice.
Do not disregard professional medical advice because of information provided by DALZO.
Stop exercising and seek appropriate medical assistance if you experience symptoms such as chest pain, fainting, severe dizziness, unusual shortness of breath, loss of coordination, severe pain, or another concerning symptom.
CLIENT RESPONSIBILITIES
Coaching clients are responsible for:
Providing accurate and complete information
Disclosing relevant injuries, limitations, medical conditions, medications, or symptoms
Obtaining medical clearance when appropriate
Using appropriate equipment
Training in a reasonably safe environment
Following instructions carefully
Communicating injuries, pain, symptoms, or health changes
Using reasonable judgment
Determining whether they are physically capable of performing an activity
Complying with applicable laws, facility rules, and event rules
DALZO may modify, pause, or discontinue a recommendation or coaching relationship when continuing participation appears inappropriate, unsafe, or outside DALZO’s permitted scope.
ASSUMPTION OF RISK
Exercise, endurance sports, running, cycling, swimming, strength training, athletic events, outdoor activities, nutritional changes, and related activities involve inherent risks.
These risks may include:
Muscle strains and sprains
Falls or collisions
Cuts, bruises, or fractures
Equipment failure
Traffic-related incidents
Water-related incidents
Overtraining
Dehydration
Heat-related illness
Cardiovascular events
Illness
Permanent disability
Serious injury
Death
By voluntarily participating in DALZO coaching, programs, events, or recommended activities, you acknowledge and accept the risks associated with participation.
You remain responsible for determining whether an activity is appropriate for your fitness level, experience, health, environment, equipment, and circumstances.
Participation in coaching or events may also require completion of a separate informed-consent and liability-release agreement.
These Terms & Conditions do not replace any separately signed coaching agreement, informed-consent form, event waiver, or release of liability.
RESULTS DISCLAIMER
Individual results vary.
DALZO does not guarantee any specific result, including:
Weight loss
Muscle gain
Faster race times
Improved endurance
Increased strength
Improved health measurements
Qualification for an event
Successful competition results
Physical transformation
Financial or business results
Results depend on factors including consistency, effort, adherence, genetics, experience, health, nutrition, sleep, recovery, stress, environment, and individual circumstances.
Testimonials, reviews, photographs, case studies, or examples do not guarantee that another person will receive the same or similar results.
APPOINTMENTS AND SCHEDULING
Clients are responsible for attending scheduled consultations, coaching calls, assessments, and appointments.
Appointments canceled with less than 24 hours’ notice may be forfeited at DALZO’s discretion.
Missed appointments and no-shows may result in the loss of the scheduled session without a refund or rescheduling credit.
Repeated cancellations, missed appointments, or excessive lateness may result in suspension or termination of services.
DALZO may reschedule an appointment because of illness, emergencies, technical problems, scheduling conflicts, or circumstances outside its reasonable control.
COACHING REFUNDS
Unless otherwise provided in a written coaching agreement:
Coaching fees are charged for access to the coaching service during the applicable billing period.
Canceling coaching stops future renewal charges but does not automatically refund the current billing period.
Completed consultations, assessments, calls, programs, and delivered materials are nonrefundable.
Missed appointments and unused services do not automatically carry forward.
Refunds may be issued when required by law or approved by DALZO in writing.
DIGITAL PRODUCTS
Digital programs, documents, videos, guides, templates, downloads, and other electronic materials are licensed to the purchaser for personal, noncommercial use only.
Digital purchases may be nonrefundable after access has been provided or the material has been delivered, except where required by law.
Purchasing a digital product does not transfer ownership of the underlying intellectual property.
Login credentials, downloads, programs, and digital materials may not be shared with another person unless DALZO gives written permission.
INTELLECTUAL PROPERTY
All DALZO branding, content, and materials are owned by DALZO or their respective licensors, including:
The DALZO name
Logos and symbols
Slogans and wordmarks
Product designs
Graphics and photographs
Videos
Website content
Training programs
Coaching systems
Written materials
Documents and downloads
Educational resources
Social media content
DALZO materials may not be copied, reproduced, recorded, modified, published, sold, licensed, distributed, uploaded, shared, or commercially exploited without prior written permission from DALZO.
Purchasing a DALZO product or service does not grant permission to use DALZO trademarks, branding, symbols, slogans, designs, or copyrighted materials.
ACCEPTABLE WEBSITE USE
You agree not to:
Use the website for unlawful or fraudulent purposes
Attempt to access another person’s account or information
Interfere with website security or functionality
Introduce viruses, malicious code, or harmful technology
Use automated systems to scrape or copy website content
Impersonate another person or organization
Provide false payment, account, or shipping information
Copy or commercially exploit DALZO content
Use DALZO branding without permission
Harass DALZO customers, coaches, employees, contractors, or community members
Use the website in a manner that could damage DALZO or its users
DALZO may restrict or terminate access for violations of these Terms & Conditions.
REVIEWS, TESTIMONIALS, AND USER CONTENT
When you submit a review, photograph, video, comment, testimonial, or other content to DALZO, you represent that:
You have the right to provide the content
The content is accurate to the best of your knowledge
The content does not violate another person’s rights
The content is not unlawful, threatening, defamatory, or misleading
DALZO will not publicly use a coaching client’s private health information, personal results, photographs, or likeness for promotional purposes without permission when permission is required.
Any separate media release or testimonial authorization will be governed by its own terms.
General ideas, feedback, or suggestions voluntarily submitted to DALZO may be used to improve DALZO products, services, and operations without an obligation to compensate the person submitting them.
THIRD-PARTY SERVICES
The DALZO website may use or link to third-party services, including:
Payment processors
Shipping providers
Scheduling platforms
Website hosts
Social media platforms
Analytics providers
Communication platforms
External websites
DALZO does not control and is not responsible for the security, availability, accuracy, policies, practices, products, or content of third-party services.
Your use of a third-party service is governed by that provider’s own terms and privacy policies.
PRIVACY
Your use of the DALZO website, products, and services is also subject to the DALZO Privacy Policy.
The Privacy Policy explains how DALZO may collect, use, disclose, retain, and safeguard personal information.
WEBSITE AVAILABILITY
DALZO does not guarantee that the website or any digital service will always be available, uninterrupted, secure, or error-free.
DALZO may suspend access for maintenance, updates, security concerns, technical issues, or circumstances outside its reasonable control.
DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, DALZO products, website content, digital materials, and services are provided on an “as available” and “as is” basis unless an express written warranty applies.
DALZO does not make warranties regarding:
Uninterrupted website access
Error-free digital services
Specific coaching results
Compatibility with every device or platform
The accuracy of information supplied by third parties
The uninterrupted availability of products or services
Nothing in these Terms & Conditions excludes warranties or consumer rights that cannot legally be excluded.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, DALZO and its owners, coaches, employees, affiliates, contractors, manufacturers, fulfillment providers, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from or connected to:
Website use
Delayed or interrupted access
Participation in coaching or training
Use of a training program
Use of general nutrition or wellness information
Athletic participation
Use or misuse of a product
Shipping-carrier delays
Reliance on DALZO content
Third-party websites, platforms, products, or services
Where liability cannot be completely excluded, DALZO’s total liability relating to a product will not exceed the amount paid for that product.
DALZO’s total liability relating to a service will not exceed the amount paid to DALZO for that service during the three months immediately preceding the event giving rise to the claim.
These limitations do not apply where liability cannot legally be limited or excluded.
INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless DALZO and its owners, employees, coaches, contractors, affiliates, and representatives from claims, losses, liabilities, damages, and reasonable expenses arising from:
Your unlawful use of the website
Your violation of these Terms & Conditions
False or misleading information you provide
Your infringement of another person’s rights
Your unauthorized distribution or commercial use of DALZO materials
This section does not require you to indemnify DALZO for conduct for which indemnification may not legally be required.
TERMINATION
DALZO may refuse, suspend, restrict, or terminate an order, coaching relationship, account, service, or website access because of:
Nonpayment
Fraud or suspected fraud
Unauthorized chargebacks
Harassment or abuse
Threatening or inappropriate conduct
Repeated missed appointments
Unsafe participation
Misuse of DALZO materials
Violation of these Terms & Conditions
Conduct considered harmful to DALZO, its customers, employees, contractors, coaches, or community
Termination does not eliminate payment obligations or responsibilities that arose before termination.
GOVERNING LAW AND VENUE
These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any legal action arising from or relating to these Terms & Conditions shall be brought in an appropriate state court located in Pinellas County, Florida, or, where federal jurisdiction exists, in the United States District Court for the Middle District of Florida, Tampa Division.
Nothing in this section limits any consumer right that cannot legally be waived or restricted.
SEVERABILITY
If any provision of these Terms & Conditions is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law.
The remaining provisions will remain in full force and effect.
NO WAIVER
DALZO’s failure to enforce any provision of these Terms & Conditions does not waive its right to enforce that provision or another provision in the future.
ENTIRE AGREEMENT
These Terms & Conditions, together with the DALZO Privacy Policy, Return and Refund Policy, and any applicable written service agreement, constitute the agreement between you and DALZO concerning your use of the website, products, and services.
Specific written terms provided for a coaching package, membership, event, preorder, promotion, or other offering may supplement these Terms & Conditions.
If a specific written agreement conflicts with these general Terms & Conditions, the specific written agreement will control with respect to that product or service.
CHANGES TO THESE TERMS
DALZO may modify or update these Terms & Conditions.
Updates will be posted on this page with a revised effective date.
Changes apply from the date they are published unless otherwise stated or required by law.
Your continued use of DALZO products, services, or the website after revised terms become effective constitutes acceptance of the updated Terms & Conditions.
